Privacy policy

On this page we explain what personal data we process when you use our website, what we use it for and what rights you have, in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR) and Spanish Organic Law 3/2018 on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD).

2. What data we process
When you place an order
- Your details as the purchaser: name, email address and telephone number.
- The recipient's details: name, telephone number and delivery address.
- The delivery date and time slot and the text of the gift card. Please bear in mind that the gift card message may contain personal information: write only what you want us to read and deliver.
- The IP address from which the order is placed.
If you provide us with another person's data (the recipient), we ask that you do so only if you have reason to believe that they would not object to receiving the gift; we will use that data solely to make the delivery.
When you write to us using the contact form
Name, email address, telephone number (optional), subject and message.
The shop has no user registration or customer accounts. We do not process your card details: payment details are entered directly on the bank's secure page (see section 5).
3. What we use it for and on what legal basis

We do not carry out profiling or automated decision-making. We will not send you commercial communications without your prior consent.
4. How long we keep it
- Order data: for as long as necessary to manage the order and deal with any issues. It is then kept blocked for the statutory periods: 6 years for accounting records (Article 30 of the Spanish Commercial Code) and 4 years for tax purposes.
- Contact messages: up to 1 year from the last communication, unless they result in an order, in which case the period above applies.
- Security logs: for the time strictly necessary for their purpose. [State specific period — VERIFY]
5. Who we share your data with
We do not sell or transfer your data. Access to it is limited to the providers we need in order to provide the service, with whom we have the contracts required by the GDPR, and to public authorities where required by law (for example, the Spanish Tax Agency).
- Web hosting and email: 1&1 IONOS España S.L.U.
- Card and Bizum payments: Redsys (Servicios de Pago) and the florist's bank. Card details are entered on the Redsys or bank page and the florist never has access to them.
- Delivery: carried out by the florist itself, without courier companies.
Third-party services that are only activated if you choose
- Google Maps: the shop map is only loaded if you accept third-party cookies or click to load it. In that case, Google Ireland Ltd. receives data such as your IP address and may transfer it to the United States under the EU-US Data Privacy Framework. More information in the cookie policy.
- WhatsApp: if you choose to contact us via WhatsApp, the link opens that application and the communication is also governed by the WhatsApp (Meta) privacy policy.
Apart from these cases, we do not carry out international data transfers.
6. Your rights
You may at any time exercise your rights of access, rectification, erasure, objection, restriction of processing and data portability, and withdraw any consent you have given, without affecting the lawfulness of processing carried out before its withdrawal.
To do so, write to us at info@floresmarien.com or by post to Plaza San Agustín, 11, 30320 Fuente Álamo de Murcia (Murcia), stating which right you wish to exercise and enclosing a document proving your identity. We will reply within one month at the latest.
If you consider that we have not handled your request properly, you may lodge a complaint with the Spanish Data Protection Agency (AEPD) (www.aepd.es).
7. Minors
You must be over 18 years of age to make purchases in this shop.
8. Security
We apply appropriate technical and organisational measures to protect your data, such as encrypted connections (HTTPS) and restricted access to order information.
9. Changes to this policy
We may update this policy when the legislation or the way we process data changes. We will always publish the version in force on this page together with its revision date.
